TERMS AND CONDITIONS OF USE

The following terms and conditions, hereinafter, the “Conditions” regulate the contractual relationship between the company TOUR-SPORT, PROMOCIONES DEPORTIVAS, SL (hereinafter, TOUR-SPORT) and the user when using the services available on this website.

TOUR-SPORT informs you that the following terms and conditions will be permanently available to the user on the website www.valenciarugbyfestival.com. We recommend reading, downloading, printing and keeping this document.

 

I.-  GENERAL ASPECTS
The conditions are written in Spanish and are basically governed by, among others, Law 34/2002 of 11th July governing Information Society Services and Electronic Commerce (LSSI) and, if applicable, Legislative Royal Decree 1/2007 of 16th November, which approves the consolidated text of the General Law for the Defence of Consumers and Users and other complementary laws. The user commits to use the website pursuant to Law, these Terms and Conditions, regulations and instructions brought to his attention, as well as morality, generally accepted proper conduct and public order.

 

II.-  PURPOSE
The purpose of this document is to establish the “Conditions” that will be applicable to the user. Likewise, you are informed that access to and use of the website www.valenciarugbyfestival.com ,,as well as the registration of the team in the tournament is subject to these conditions of use and the tournament rules and regulations.

 

III.- CONDITIONS OF THE SERVICE AND TOURNAMENT REGULATIONS
The use of the account is personal and non-transferable, the transfer, even temporarily, to third parties being prohibited. The user guarantees the veracity of the data entered. Identity theft and the creation of false profiles are strictly prohibited. In the event that TOUR-SPORT has evidence of the non-veracity of said data, the creation of false profiles or unlawful or fraudulent use is identified, the account will be immediately cancelled. The data provided when registering should be kept up-to-date by the user as well as kept safe in order to prevent unauthorized access.

Unauthorised uses: It is strictly prohibited to use abusive or slanderous content, regardless of the fact that this content affects other users or other persons or clubs, publish or transfer illegal, fraudulent, defamatory, obscene, pornographic, sexually explicit, threatening, abusive, violent, discriminatory, offensive, abusive content, or that constitutes or fosters criminal conduct, gives rise to civil liability or infringes in any other way the rights of third parties. Likewise, the user is prohibited from disturbing or interfering in the website, damaging its operatability or availability (for example, by publishing or transferring any information or software containing viruses, trojans, worms, malware or any other harmful device, etc…)

TOUR-SPORT may amend, update, delete the content, information, design and structure of the website as it unilaterally sees fit without the need for advance notice.

TOUR-SPORT reserves the right to limit, exclude, cancel or condition users’ access, and to delete content entered by users unilaterally without the need for advance notice, and without generating the right to any compensation on the part of the user.   

TOUR-SPORT is interested in providing the user with a quality service, though continuity in the service cannot always be guaranteed. In the event that access to the website is interrupted, TOUR-SPORT shall take the measures within its reach to re-establish it as soon as possible, but shall not be liable for the consequences of damage caused by such stoppage. The user recognizes that the website may not be available for maintenance reasons.

 

REGULATION

 

1. REGULATIONS

a) Rules

The tournament will be played in accordance with the rules established by the respective regulations of the International Rugby Board (IRB) and the Spanish Rugby Federation (FER).

 

b) Tournament format

There will be groups of 4 teams in all age categories. All the teams from each group will play against the other teams in their own group, thereby guaranteeing a minimum number of matches.

Those classified in first and second place play the FINAL PHASE as a qualifying stage
Those classified in third and fourth place play the FINAL PHASE B as a qualifying stage
Each match won awards 3 POINTS
Each drawn match awards 2 POINTS
Each match lost awards 1 POINT
Each match not played awards 0 POINTS

  1. If a group match has been stopped both at half time and in the second half, the result and the tries and points scored by each team in the course of the match will be maintained.
  2. If a group match has been stopped during the first half, the match will be considered null and void.
  3. If a match is considered null and void, each of the teams participating in the match will obtain two points and all the points and tries will be taken into account in the total points and tries scored by each team in the group match total.

 

c) Group stage classification.

If, at the end of the group matches, two teams are drawn on points for any position, said position will be decided by the result of the match between the drawn teams. The team that wins the match between them will be considered to have the best classification.

If the match between the two teams that are drawn on points at the end of the group matches is a tie, the position in the classification will be established by meeting the following criteria:

  1. The difference between the points scored and registered for each team tied on points in all the group matches. The team with the largest points difference in its favour will have the best classification.
  2. The difference between tries scored and registered for each team tied on points in all the group matches. The team with the greatest tries difference in its favour will have the best classification.
  3. Whichever team has scored the greatest number of points in the course of the group matches will have the best classification.
  4. Whatever team has scored the greatest number of tries in the group matches will have the best classification.
  5. The best classification will be decided by a draw between the team delegates.

 

d) Qualifying classification.

  1. When a match ends in a tie, extra time (extensions) will be played. After a 1-minute break, the extra times will be played in 5-minute periods. After each 5-minute period, the teams will change ends and there will be no half-time break. The first team to score will be declared the match winner. Should there stil be a tie, the classification will be decided by what is established by the Match and Competition Regulations of the FER (1. Tries, 2. Drops, 3. Penalty Tries, 4. Conversions 5. Penalty Kicks).
  2. If a match has been stopped both during half time and the second half, the results will be maintained. If both teams are tied, the team that has managed to get the greatest number of points in the course of the championship will be the winner. If the winner cannot be determined, the same conditions will be applied for the group matches. Therefore, if one of the teams has taken part in a group in which a team has been sent off for whatever reason, the issue shall be taken up by the Legal Committee, which will select the most appropriate method to determine the winner of the qualifying game in question.
  3. If a match has been stopped during the first half, it will be null and void and the provision of Clause A will be used to determine the winner. Therefore, if one of the teams has taken part in a group in which a team has been sent off, for whatever reason, the issue will be taken up by the Legal Committee, which will select the most appropriate method to determine the winner of the qualifying match in question.

 

2. MATCH SCHEDULE

The calendar will specify the time of the match, the pitch on which it will be played and the corresponding age bracket. A team may have to play more than one match a day, depending on how the group in which it has been put is set up.

The Organisation reserves the right to change groups, schedule, pitches and match times. Delegates from the affected teams will be given notice ahead of time.

 

3. MATCH DURATION

A match does not last more than 14 minutes, plus injury time and extra time.
A match is divided in to two halves of no more than 7 minutes’ playing time.
Exception: the final of a competition cannot last more than 20 minutes plus injury time and extra time. The match is divided into two halves of no more than 10 minutes’ playing time.
HALF TIME After half time, the teams change ends. Half time lasts no more than 2 minutes.
EXTRA TIMES - DURATION When a match ends in a tie and extra time (extension) is necessary, extra time is played in 5-minute periods after a 1-minute break. After each period, the teams change ends with no break.

4. CHECKING PARTICIPANTS

The tournament will check all participants on arrival, so the delegate or person responsible for the team must bring each player’s original ID card or passport. Any player who does not show one of these document will not be registered.

 

5. NUMBER OF PLAYERS

EACH TEAM MAY REGISTER A MAXIMUM OF 14 PLAYERS IN THE TOURNAMENT.
A MAXIMUM OF 12 PLAYERS MAY BE REGISTERED FOR EACH MATCH.
MAXIMUM NUMBER OF PLAYERS IN THE PLAYING AREA: each team must have no more than 7 players in the playing area.
PLAYERS DESIGNATED AS SUBSTITUTES: a team can name up to five players for changes or substitutions. A team can substitute or change up to five players.
SUBSTITUTED PLAYERS RETURNING TO THE MATCH: A substituted player may re-enter the pitch.

Any player from the same club is allowed to be used in different categories. For this, he should comply with the age and be registered in the respective lists.
In no event may a player be registered in different teams of the same category.

 

6. DOCUMENTS TO BRING TO EACH MATCH

15 minutes before each match, the team’s delegate should hand over to the referee one of the lists he was given when ages were being checked.
The number each player wears on his back must be written in the designated column and the 7 first team players should be marked.
It is obligatory to bring one of the following original documents of each player to the match:
• ID card or passport.
No match can start without the referee having the player lists.

 

7. COMPLAINTS

Delegates who want to check whether any player should be allowed to play can do so before the end of the match by speaking to the Organisation official for that pitch. At the time of the claim, the complainant must make a deposit of 20 Euros for each player they suspect.
If the player proves their legality by submitting any of the required original documents, the pitch official will finalise the claim.
If the player under suspicion does not have the requested document available or does not appear on the lists, both the claimant and the player (together with the team leader) will have to go to the headquarters of the tournament Competition Committee (Information Central) two hours later which will make the final decision.
In any case, if the player under suspicion proves their legality, the claimant will lose their deposit. Otherwise it will be returned in full.

Complaints about refereeing errors will not alter the outcome of the game. The Competition Committee's decision is final and irrevocable. The interpretation of the facts and the rules shall be final.

 

8. PUNCTUALITY

All teams must be on the pitch 15 minutes before the match starts. If this is not the case and there is no good reason, the Competition Committee may take one of the following measures:
• The team on the pitch will be awarded a 3-0 win for the match
• The offending team will automatically lose the match and be deducted a point. .
• The referee will decide if the match should be played or not.

If a team does not appear for a match with no good reason, the offending team will forfeit that game (3-0) and be deducted three points. In both cases, the Competition Committee reserves the right to discipline a team should a third party be affected.

 

9. REFEREES

The match referees will be appointed by the Valencian Rugby Federation.

 

10. STRIPS

The players of the teams participating in the championship must enter the pitch wearing the proper strip with their club’s colours and have their respective player number on said strip.
The participating teams should bring two different strips to be used in the event of two teams having similar colours. The change of colours will be decided by a draw.

 

11. RUGBY PITCHES

All the pitches are made of top quality artificial turf.

 

12. TROPHIES

After each final, trophies and medals will be awarded to the winner and runner-up of each age category, as well as the best player trophy for each of the finals
In addition, a trophy will be awarded for best club during the tournament. The best club in the tournament will be decided by the Organisation based on the following parameters:
• A match won during the qualifying round: 1 point
• First place in their qualifying group: 1 point
• A match won during the knockout and final stages: 2 points

If a club participates in the tournament with more than three teams, the points of the top three teams will be counted.
In case of two clubs having equal points, the winner will be decided using the same criteria as in "Tournament Format".

All players will be given a diploma certifying their participation in the tournament.

    IV.- CONTENT
    Entering unauthorised content or content that threatens the basic rights of persons, affects the privacy of third parties or in any way infringes their rights is prohibited.

    TOUR-SPORT cannot control each and every piece of content published, therefore, it cannot assume responsibility for the content, pursuant to the principle of effective knowledge of the LSSI.

     

    V.- LIABILITIES
    TOUR-SPORT does not guarantee the liability, availability or continuity of the operatability of the website, and shall not be liable for the stoppage of the service, suspension, the server temporarily being down, potential omissions, losses of information, data, settings, unauthorised access or violation of confidentiality resulting from technical or communication problems, or human omissions caused by third parties or not attributable to TOUR-SPORT.

    Likewise, it is not bound to control and does not control beforehand the absence of viruses or elements in the content, which may cause changes in the software or hardware of users or any persons visiting the website, therefore, it shall not answer for any damage or harm of any nature that could result therefrom.

    TOUR-SPORT shall make every effort to maintain the service operational. However, there may be technical problems that cause sporadic stoppages. The availability and quality of the service can vary depending on different factors, such as the type of device used by the user, the geographical location of the user, the broadband available and/or the speed of the Internet connection, therefore, it shall be the user’s responsibility to ensure that the systems and infrastructures he has are appropriate and required for the proper reception of the service, as well as their configuration.

    TOUR-SPORT declines any liability for content, data and/or information provided by the website’s users, and for the content of external websites to which there are links. The presence of said links does not imply the existence of any commercial relationship with the linked websites, nor the acceptance or control of their content.

    TOUR-SPORT shall not be liable for the content of the linked website or for any responsibilities they may incur, nor does it guarantee the security conditions thereof, as well as the absence of viruses or its proper operation.

    TOUR-SPORT shall in no event be liable for the internal messaging of the clubs with the sportsman using the website, and is in no event answerable for the reality of the sports curriculum of the sportsman.

     

    VI.- INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
    All content is protected by intellectual property regulations, in particular by RDL 1/96 of 12th April that approves the Consolidated Text of the Intellectual Property Law. The design, software, source code and, in general, all content, including texts, photographs, charts and the design, settings, structure, colour combination and any other element that is located on the website are original creations. The rights to the content belong to TOUR-SPORT or, if applicable, to third parties.

    The logos and trademarks are registered. TOUR-SPORT is the holder of the industrial property rights or possesses the respective licences for the exploitation of the trademarks, brand names, designs, industrial models, utility models, patents, domain names and any other industrial property rights included in this website. In no event does the use of the website imply the assignment, transmission or any other kind of waiver, whether full or partial, of the intellectual or industrial property rights. Use of the website entails a free, non-exclusive, revocable licence that is for the user’s personal use.

    VII.- APPLICABLE LEGISLATION
    This agreement is governed by Spanish legislation. In the event of any dispute that could arise between the parties with regard to its validity, fulfillment or cancellation, they shall refer to the Spanish courts where the user has its address, should it have the capacity of consumer.
